Department of Homeland Security

Recently we signed up with E-Verify Services through Department of Homeland Security as a government contractor of services. E-verify allows us to verify individuals that apply with us for employment opportunities. Because of recent policies when hiring potential applicants we can now screen for both government contracts and for local employment verifying your US citizen status and the right to work for Bits or Bytes World Services as we are a company based in the United States. Bits or Bytes World Services is wholly owned by BOBWS, LLC a Texas based entity.

Because of this we also employ scripts on our server which monitor our server services, and accurately informs us about visitors to our servers. Programing on our webserver uses advanced techniques. People or individuals that visit our servers need to be aware that we participate in the reporting process. We have certain policies in place that we strictly follow as a registered LLC and participant with Homeland Security.

Currently there are no opportunities available as we are developing our services. However on our contact page if you may be interested in assisting us with our growth please drop us an e-mail. Please follow the guidelines set up. They are specific.

Terms of Service Policy (TOS)

Bits or Bytes World Services provides digital delivery services for clients around the globe. Therefore the following TOS (Terns of Service) agreement in place is enforceable as it is in public view. Violation of any part of this TOS of the conditions stated below, your services will be reviewed and subject to immediate termination review depending on the severity of the violation. If your services are terminated you will forfeit any balance that may be due, you can be fined or other remedies will be pursued depending on the damages to any other third party by BOBWS, LLC a Texas enitity authorized by their operating procedure. We have an obligation to protect your private information, however if damages to a third party are sustained because of any illegal activity on your part we will supply your contact information and will participate with federal agencies that request information.

Transmitting spam, viruses or harmful computer programs; failing to provide an optout option on e-mail that solicits purchases of your products sent to your client base where a person can optout of being notified if they choose to; use of scripting in your web pages to control or extract personal information from a users computer or to place a controlling web bot or participate in the distribution of web bots to control anothers personal computer;

• Violate any law or infringe on a third party’s Terms of Service

All services provided by Bits or Bytes World Services maybe used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Bits or Bytes World Services from any claims resulting from the use of service which damages the subscriber or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to Bits or Bytes World Services servers, or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

pirated software
hacker programs or archives
Warez sites
pornographic material
adult websites
transmission of illegal software, pornographic picture
illegal botnets

IMPORTANT NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A $500.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, BITS OR BYTES WORLD SERVICES WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.

Traffic Usage
All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $1.00 for each gig of traffic exceeded. This amount is not prorated, meaning that 1 mb - 1 gig will be treated and billed as the same.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Server Abuse
Any attempt to undermine or cause harm to a server or customer of Bits or Bytes World Services is strictly prohibited. As our customer you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled without chance of refund.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Billing
By the Account Activation Date of each year, Bits or Bytes World Services shall either:

(1) debit the client's credit card (when such information has been provided by the client); or

(2) deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current year. When an invoice is delivered to the client, payment shall be remitted to Bits or Bytes World Services by no later than the specified payment due date. Bits or Bytes World Services shall be entitled to immediately terminate this agreement for client's failure to make timely payments. All credit cards are billed automatically on a monthly basis. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 24 hours. If we do not receive a response within 24 hours, the account, and all accounts under that account plan, will be suspended.

Service Fees
Certain services carry a setup fee charged by Bits or Bytes World Services to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to Bits or Bytes World Services and agrees to pay any and all fees incurred by client. Because the services are provided on a yearly basis the client will be responsible for service fees incurred each year. You must notify us within the first 30 days of service that you wish us to process a refund for you because you wish to terminate services. After the 30 day period has lapsed all fees are non-refundable through the end of the 12 month period. You agree that no exceptions can me made with this policy and that it is enforceable.

Account Deactivations
Any account deactivated due to non-payment will require a reactivation fee of $25.00 prior to reactivation.

Cancellation Refunds
We DO NOT refund partial yearly fees to accounts. We require
notice to be made within the first 30 days of service.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Limitation of Liability
Bits or Bytes World Services shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Bits or Bytes World Services servers going off-line or being unavailable for any reason whatsoever. Furthermore, Bits or Bytes World Services shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Bits or Bytes World Services Servers. All damages shall be limited to the immediate termination of service.

Violations
Violations of these Acceptable Use Policies should be referred to sales@bitsorbytes.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer
Bits or Bytes World Services cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Bits or Bytes World Services are resold. Thus, certain equipment, routing, software and programming used by Bits or Bytes World Services are not directly owned or written by Bits or Bytes World Services . Moreover, Bits or Bytes World Services holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Bits or Bytes World Services sees fit.

Account Activation
By activating your account with Bits or Bytes World Services, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

Server Uptime Guarantee
Bits or Bytes World Services guarantees 99%% service (http, ftp, pop, imap, smtp) uptime on all hosting plans.

Bits or Bytes World Services reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.

Acceptable Use Policy

As a provider of web site hosting and other Internet-related services, Bits or Bytes World Services offers its customer (also known as "Subscribers") and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. Bits or Bytes World Services respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, Bits or Bytes World Services reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, Bits or Bytes World Services has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using Bits or Bytes World Services. This AUP will be revised from time to time.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through the Internet, they must keep in mind that Bits or Bytes World Services cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because Bits or Bytes World Services cannot monitor or censor the Internet, and will not attempt to do so, Bits or Bytes World Services cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.

When subscribers disseminate information from the Internet, they must keep in mind that Bits or Bytes World Services does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over Bits or Bytes World Services network and may reach a large number of people, including both subscribers and non-subscribers of Bits or Bytes World Services , subscribers' postings to the Internet may affect other subscribers and may affect Bits or Bytes World Services goodwill, business, reputation or operations. For these reasons, subscribers violate Bits or Bytes World Services policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:

Spamming:
Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward Bits or Bytes World Services , but also because it can overload Bits or Bytes World Services network and disrupt service to Bits or Bytes World Services subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, Bits or Bytes World Services will investigate and shutdown the account that is SPAMing. A $350.00 charge for violating this policy will be charged to the person initiating the SPAM, and a fine of to $10,000.00 can be charged off against the violating party should a damaged party decide to litigate. Furthermore Bits or Bytes World Services reserves the right to prosecute for this violation. A $10.00 charge will be assessed PER EMAIL sent should Bits or Bytes World Services choose to pursue and prosecute.

Audio/Video Streaming:
Audio/Video Streaming is not hosting friendly. As such, Bits or Bytes World Services does not allow any streaming of audio or video content. Offending accounts will be suspended without noticed or terminated.

Adult-Oriented Content:
Bits or Bytes World Services does not allow illegal adult content. Any one found hosting illegal adult content will have their account terminated and will no longer be allowed to host with Bits or Bytes World Services !

Botnets or forming an illegal Botnet:
If you form a Botnet on our servers in an effort to control another users computer, server, or any other devices that
accesses the internet, Bits or Bytes World Services will immediately cancel and terminate your services. You will be accessed a $1000.00 dollar fine. In addition if we decide to litigate the matter you agree to pay all costs that Bits or Bytes World Services incurs including attorneys fess and any
damages incurred.

Website Design and Hosting:
Websites currently hosted by Bits or Bytes World Services have licensing agreements in place. If you are a web designer or a firm that performs web design for any client of Bits or Bytes World Services you agree that any and all files placed on Bits or Bytes World Services Servers are completely licensed and that no copyright or anytype of ingringement exists with any of the material. This includes pictures, content, or any material that infringes on anothers intellectual rights. It is your sole responsibility to insure this when you use web templates from the numerous providers and picture sources out there that the material is properly licensed. Bits or Bytes World Services will be completely indeminfied against any outside firm that notifies us of this type of violation. If notification of this type takes place we will notify you that they have claimed infringement and what the infringement is in accordance to Federal Policy. You will have 24 hrs to respond to the party that raised the issue and remove the content or contest the content. But this will be your sole responsibility to notify the party that raised the issue and work through it with them and not a responsibility of Bits or Bytes World Services.

Large File Policy:
Bits or Bytes World Services is not for file hosting and distribution - as such, customers may not host any files larger than 50MB in size that are observed to be available for the sole purpose of download. Such files include but are not limited to .ISO, audio/video files, .EXE files. If you are unsure whether your file is against this policy.

Obscene Speech or Materials:
Using Bits or Bytes World Services network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. Bits or Bytes World Services is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

Defamatory or Abusive Language:
Using Bits or Bytes World Services network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

Forging of Headers:
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

Illegal or Unauthorized Access to Other Computers or Networks:
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities:
Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment. By doing so Bits or Bytes World Services will be completely indemnified, your account will be suspended and the party that was damaged can seek compensory damages against you for your disruption activities.

Scanning Software and Scripts:
Any scanning software or scripts that are setup to scan anothers website on Bits or Bytes World Services server or any other server located on the internet to steal another intellectual property is strictly prohibited. This includes software that scans and mines for e-mail addresses.

Facilitation a Violation of this AUP:
Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mail bombing, denial of service attacks and piracy of software.

Export Control Violations:
Exporting encryption software over the Internet or otherwise, to points outside the United States.

Usenet Groups:
Bits or Bytes World Services reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

Other Illegal Activities:
Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

Other Activities:
Engaging in activities, whether lawful or unlawful, that Bits or Bytes World Services determines to be harmful to subscribers, operations, reputation, goodwill or customer relations.

As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. Bits or Bytes World Services will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with Bits or Bytes World Services policy or applicable law. However, when Bits or Bytes World Services becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by Bits or Bytes World Services.

Bits or Bytes World Services is also aware that many of its subscribers are themselves providers of Internet services, and that information reaching Bits or Bytes World Services facilities from those subscribers may have originated from a customer of the subscriber or from another third party. Bits or Bytes World Services does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers. Bits or Bytes World Services reserves the right to directly take action against a customer of its subscribers. Also, Bits or Bytes World Services may take action against the Bits or Bytes World Services subscriber because of activities of a customer of the subscriber, even though the action may affect other customers of the subscriber. Similarly, Bits or Bytes World Services anticipates that subscribers who offer Internet services will cooperate with Bits or Bytes World Services in any corrective or preventive action that Bits or Bytes World Services deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of Bits or Bytes World Services policy.

Bits or Bytes World Services will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. Bits or Bytes World Services may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, Bits or Bytes World Services may disclose information, including, but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. Bits or Bytes World Services assumes no obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, Bits or Bytes World Services may disclose subscriber information or information transmitted over its network where necessary to protect Bits or Bytes World Services and others from harm, or where such disclosure is necessary to the proper operation of the system. However, Bits or Bytes World Services will never sell information to other services or outside companies.

Bits or Bytes World Services expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber's failure to comply with those laws will violate Bits or Bytes World Services policy. Finally, Bits or Bytes World Services wishes to emphasize that, in signing the Service Agreement, subscribers indemnify Bits or Bytes World Services for any violation of the Service Agreement, law or Bits or Bytes World Services policy resulting in loss to Bits or Bytes World Services or the bringing of any claim against Bits or Bytes World Services by any third party. This means that, if Bits or Bytes World Services is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will be responsible for payment of any damages awarded against Bits or Bytes World Services, plus ALL costs and reasonable attorney's fees that are incurred.

We hope this AUP is helpful in clarifying the obligations of Internet users, including Bits or Bytes World Services and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to contact.us@bitsorbytes.com.

trademark or copyright; using a bot or spider software to steal another persons works and then display them on your website is strictly probited by Federal Copyright Law; placing software on our servers to spider anothers website to collect e-mail addresses is not allowed;

• Engage in morally objectionable activities, including but not limited to those which are child pornographic, adult content of any nature, defamatory, abusive, harassing, obscene, racist, or otherwise objectionable material. Adult services are not allowed.

Violation of any listed item above, you can be fined for each offense committed on our servers. We do not need a court order to enforce our TOS policy, it is clearly outlined in this Public View document. BOBWS LLC, Bits or Bytes World Services and Granbury Webhosting is completely indemnified by any damages you cause another.

Regular E-mail is allowed, however solicitation of a product for sale requires that you follow proper procedures in your e-mail before embarking on an e-mail campaign. We want you to be successful with your e-mail campaigns, but also want you to respect the rights others have on the internet. We have provided this link to help assist you. Therefore, our website has been developed with that in mind. We know and respect your rights and will not sell any information concerning you and your company to another party. We are a private growing company.

 

1) What about pages that ask for personal information?

When customers supply information about themselves for a specific purpose, we use the information for that purpose (such as to provide the service or information the visitor has requested).

For example, you may be asked to give us individual information to purchase a product or service, receive information, manage online account registration, or apply for a job. The information may range from your zip code, to your phone number, account number, e-mail address or mailing address. When visitors use our web site to order products, we may use this individually identifiable information as we would use the same information obtained in a traditional non-electronic manner.

 

2) What happens with information when I fill out registration forms?

We encourage all our visitors to register with us, although registration is only required for certain transaction-related areas of Bits or Bytes World Services. When you are filling out registration forms please provide accurate information (like name and e-mail address).

Your name and e-mail address are only used to send you information about our company, product updates, special offers, and on-line newsletters. We strive to ensure that the information we obtain and use about our customers is accurate to better serve your needs.

Bits or Bytes World Services does not sell, share or trade customers email addresses to any other party. We only use your email address to provide you with excellent service, and to update customers concerning deals on specials. Bits or Bytes World Services firmly believes that a customers email address is personal and it will remain that way.

 

3) What about credit card purchase?

The agreements we have with our online vendors requires that we protect your purchase made online. We use Pay Pal as our online transaction service provider which incorporates strong encryption techniques. We also incorporate strong encryption techniques and use a secured 256 bit Security SSL Certificate protecting transaction on our web portal. When make a credit card purchase, your credit card information is not retained by our company as all purchases are securely conducted through Pay Pal.
